2. The petitioner seeks bail in a case registered for the offence punishable under Section 365 of the Indian Penal Code.

3. As per prosecution case, on 22.10.2023 at about 11 PM, after talking on phone to one Ruchi for about half an house, son of informant left the house and did not return.

4. It is submitted by learned counsel for the petitioner that petitioner is not named in the F.I.R. and has committed no offence. Name of petitioner has transpired in this case on the basis of confessional statement of one Vikash Kumar @ Vikash Yadav, who ha already been granted the privilege of bail by this Hon'ble Court vide order dated 09.08.2024 passed in Cr. Misc. No. 40453 of 2024. Petitioner has got no criminal

Patna High Court CR. MISC. No.62827 of 2024(2) dt.06-12-2024 2/2 antecedents and he is in custody since 05.04.2024. Moreover, charge-sheet has already been submitted.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, rival submissions, nature of accusation, claim based on parity, clean antecedents and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, IV, Patna City, Patna in connection with Alamganj P.S. Case No. 989 of 2023.
