JUSTICE SANJAY PRIYA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in Chouri P.S. Case No. 78 of 2016 instituted for the offence under Section 7 of Essential Commodities Act, 1955.

It is alleged that on inspection of the PDS shop of the petitioner, it was found that the petitioner has kept food grains for the purpose of black marketing.

From the written report it appears that mere vague allegation has been made that the petitioner has kept food grains for black marketing purpose. The seizure list does not bear signature of the petitioner. The petitioner is a lady. It is mentioned in paragraph-3 of the bail petition that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.7403 of 2017 (3) dt.16-03-2017 2/2 Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Chouri P.S. Case No. 78 of 2016, she shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-12, Ara, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
