JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-09-2024 Learned counsel for the petitioners seeks permission to withdraw the bail application with respect to petitioner no. 3, namely, Ayub Khan @ Ayub Ali, since during the pendency of this case, he has been arrested.
2. Permission is accorded.
3. Accordingly, the bail application with respect to petitioner no. 3 is dismissed as withdrawn.
4. Heard learned counsel for rest of the petitioners and learned A.P.P. for the State.

5. The petitioners apprehend their arrest in connection with Adhaura P.S. Case No. 33 of 2024 registered under Sections 341, 323, 307, 504, 353, 379 and 34 of the Indian Penal Code.
6. The brief facts of the case are that on the alleged date and time of occurrence, informant who is a Forester, got secret information that one pickup van bearing Reg. No. BR24-G-6511 loaded with Mahua was going to U.P., then informant intercepted the said van, and a man who called through his mobile phone the other accused persons who came there having iron rods and sticks in their hands and assaulted informant and his driver, due to which the driver received injury on his head. It is further alleged that the accused persons also snatched a gold chain from neck of informant.
7. Having considered the accusation and gravity of offence, prayer for anticipatory bail of the petitioners is rejected. (Prabhat Kumar Singh, J) utkarsh/- U T
