JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-04-2015 This application under Articles 226 and 227 of the Constitution of India has been filed by the petitioner for issuance of an appropriate direction to respondent no.5 to execute the order dated 19.11.2013 passed by the learned Judicial Magistrate, 1st Class, Patna in Complaint Case No.644(C) of 2012 whereby the learned Magistrate has directed the office to issue process under sections 82 and 83 of the Code of Criminal Procedure against the person named in the complaint case in which cognizance has been taken under section 138 of the Negotiable Instruments Act and 406 of the Indian Penal Code.
In my view, the application is thoroughly misconceived.
