JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 831/2008, disclosing offences under Sections 498A of the Indian Penal Code.

Petitioner happens to be husband of the complainant and allegation against him is of demand of Maruti Car as dowry and on non fulfillment of the said demand, he subjected the complainant to torture and cruelty.

Submission of learned counsel for the petitioner is that the decree of divorce has already been passed in favour of the petitioner and all the articles have already been handed over to the complainant but in spite of that the complainant has lodged this false case.

Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Bhagalpur, in connection with Complaint Case No. 831/2008, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that petitioner will cooperate in disposal of complaint case.
