JUSTICE PRABHAT KUMAR JHA ORAL ORDER 19-09-2017 Heard the learned counsel for the petitioners, the learned Additional Public Prosecutor and the learned counsel for the informant.

The petitioners apprehend their arrest in Naokothi P.S. Case No. 38 of 2017 under Sections 341, 323, 342, 420, 467, 468, 471, 472, 486, 504 and 506/34 of the Indian Penal Code. The informant named the petitioners and alleged that the petitioners forcibly took him to the house of Ranjeet Singh @ Hira Singh @ Ranjeet Kumar and tied him with Saguan tree. The accused forcibly assaulted him. The informant, further, alleged that they took him to registry office and forcibly got a sale deed executed.

The learned counsel for the petitioners submits that co-accused, Ranjeet Singh @ Hira Singh @ Ranjeet Kumar, got

Patna High Court Cr.Misc. No.43442 of 2017 (2) dt.19-09-2017 2/2 the sale deed executed in his favour. There is no specific allegation against the petitioners.

The learned counsel for the informant submits that the allegation is very serious in nature.

But, it appears that the petitioner, at whose instance, the occurrence took place and the land was forcibly executed in favour of Ranjeet Singh @ Hira Singh @ Ranjeet Kumar, he has already been granted anticipatory bail by order, dated 29.08.20017, passed in Cr. Misc. No. 38801 of 2017 and the case of the petitioners stand on better footing.

Considering the aforesaid fact, let the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Naokothi P.S. Case No. 38 of 2017 to the satisfaction of Sri Raghubir Prasad, Judicial Magistrate, 1st Class, Begusarai, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
