JUSTICE SANJAY PRIYA ORAL ORDER 01-11-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Katihar (Nagar Sahayak) P.S. Case No. 450 of 2017 instituted for the offence under Sections 302/34 of the Indian Penal Code. The petitioner is husband of the deceased. There is allegation that petitioner has committed torture with the daughter of the informant (since deceased) when she made protest of having illicit relationship of the petitioner with another lady. It is further alleged that this petitioner always used to assault the daughter of the informant for such objection. The daughter of the informant ultimately was done to death by pressing her neck. The post mortem report has been enclosed as Annexure-2 wherein the Doctor has found the death due to
Patna High Court Cr.Misc. No.45021 of 2017 (3) dt.01-11-2017 2/2 Asphyxia as a result of hanging.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
