JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 This is an application for grant of anticipatory bail in connection with Shikarpur P. S. Case No. 100 of 2019, disclosing offences under Sections 406 and 420 of IPC. As per F.I.R. petitioner has induced the informant to pay him altogether Rs.08 lacs by different cash, cheques and bank drafts for allotting an agency of Indian Oil Corporation, but he has not get allotted any agency in the name of the informant nor returned the amount on demand.

Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted. The above amount has never been deposited in his account and he has falsely been implicated in this case, only because he is a local Journalist.

Heard learned A.P.P. also, who has opposed the prayer

Patna High Court CR. MISC. No.59473 of 2019(4) dt.20-11-2019 2/2 for anticipatory bail on the ground that the materials collected during the investigation shows that amount has been deposited in the account of the petitioner and as such, it appears that intention of the petitioner was to defraud the informant in this case.

Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender and pray for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court.
