Heard learned counsels for the petitioners and the Respondent-State.
The present writ application has been filed for a direction to the respondent authorities to make payment of the due amount of the petitioners, calculated to the tune of Rs. 82,950/- + Rs.72,200/- + Rs.14,000/- respectively, total amounting to Rs.1,69,150/- against utilization of their vehicles from the period 26.10.2010 to 01.11.2010 during Bihar Assembly Election, 2010.
Patna High Court CWJC No.1743 of 2018(2) dt.27-08-2018 2/3 However, learned counsel for the petitioners confines his prayer only for disposal of representation dated 06.10.2015, as contained in Annexure-2, pending before the Respondent No.4, the Circle Officer-cum-In-charge Officer, Vehicle Cell, Danapur, Patna, which was submitted with a prayer to pay the due amount against their vehicles utilized during the Bihar Assembly Election, 2010.
It is submitted by learned counsel for the petitioners that the vehicles of the petitioners were utilized during the Bihar Assembly Election, 2010 and the Circle Officer, Danapur, vide Letter No.3016, dated 12.12.2015 sought guidelines from the Sub-Divisional Officer, Danapur with regard to making due payments to the petitioners against their vehicles utilized during Bihar Assembly Election, 2010, as contained in Annexure-3, but till date the payments have not been made.
Learned AC to GA-7 submits that if the payments of the petitioners against their vehicles being utilized during the Bihar Assembly Election, 2010, have not been made till date, a decision will be taken to that effect within a time frame. Accordingly, the respondent authorities, particularly, the Respondent No.4, the Circle Officer-cum-In-charge Officer, Vehicle Cell, Danapur, Patna is expected to take a final decision
Patna High Court CWJC No.1743 of 2018(2) dt.27-08-2018 3/3 with regard to the payment of due amount against the vehicles of the petitioners being utilized during the Bihar Assembly Election, 2010 within a period of four weeks after receipt/production of a copy of this order.
