The petitioner apprehends his arrest in connection with Mahila P.S. Case No.40 of 2021 registered under Sections 323, 498(A), 504, 506/34 of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is the husband of O.P. No.2 and he never demanded any dowry nor tortured her. He further submits that the F.I.R. has been lodged after one year of the alleged occurrence. The
Patna High Court CR. MISC. No.60993 of 2022(2) dt.03-01-2023 2/2 petitioner has got no criminal antecedent.
Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahila P.S. Case No.40 of 2021, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
