The petitioners apprehend their arrest in Dharahara P.S. Case No. 158 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. Pinki Devi the informant alleged that on account of constructing drainage some verbal altercation took place. Arvind Paswan and Sulo Devi are alleged to have assaulted the mother-inlaw and sister-in-law of the informant. It is submitted that there is a land dispute between the parties. Prior to the occurrence a Panchayati was also held. The informant and his side had undertaken not to construct drainage on the land of the petitioner. It is further submitted that Pinki Devi
Patna High Court Cr.Misc. No.671 of 2015 (3) dt.22-01-2015 got injuries caused by sharp cut weapon as well as hard blunt object, but the injuries are simple in nature. Considering the facts aforesaid and the fact that on account of some petty land dispute, the occurrence took place between the parties and there is case and counter case and the injuries are simple in nature, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Dharahara P.S. Case No. 158 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
