This application is for grant of anticipatory bail for the offence under Sections 47 (A) and 53 (A) of Bihar Excise (Amendment)Act, 2016.

The allegation against the petitioner is about recovery of half bottle of 180 ml. foreign liquor.

It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case and nothing has been recovered from the conscious possessions of the petitioner. Heard learned A.P.P. also.

Having heard both sides and in view of the quantity as

No.52043 of 2016 (2) dt.20-12-2016 2/2 mentioned in the seizure list, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Madhepura in connection with Singheshwar P.S. Case No.91 of 2016, subject to conditions as laid down under Section (2) of the Code of Criminal Procedure.
