The petitioner seeks pre-arrest bail in connection with Chiksaura P.S.Case No. 20 of 2016 registered under Sections 341, 342, 323, 504, 506 and 365/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the story narrated by the informant in the FIR is highly unbelievable. He submitted that apart from Section 365 of the Indian Penal Code, all other Sections are bailable in nature. According to him, even the ingredients of Section 365 of the Indian Penal Code are not attracted to the facts of the present case. Learned counsel for the State has opposed the

Patna High Court Cr.Misc. No.46061 of 2017 (2) dt.04-10-2017 2/2 application for grant of pre-arrest bail of the petitioner. Considering the nature of allegation and the submissions made by the learned counsel for the petitioner that the petitioner is having no criminal antecedent, in the event of arrest or surrender before the court below within four weeks from today, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Chiksaura P.S.Case No. 20 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
