The petitioner apprehends his arrest in Azamnagar (Salmari O.P.) P.S. Case No. 197 of 2016 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379, 427, 504 and 506 of the Indian Penal Code.
It is alleged against this petitioner that he assaulted on head of informant with iron rod causing injury on his head. The petitioner has enclosed the injury report as Annexure-3, from which, it appears the doctor has found three injuries, one lacerated cut injury over skull and second bleeding through left ear and third painful swelling. In such manner, he has not given any description of the injury. The doctor has simply stated that patient was
Patna High Court Cr.Misc. No.51662 of 2016 (3) dt.18-01-2017 2/2 referred to better treatment. Opinion is to be ascertained only after C.T. Scan. In the aforesaid, no report of CT Scan is available. In the circumstances, prayer of the petitioner for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Azamnagar (Salmari O.P.) P.S. Case No. 197 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Katihar, subject to the conditions as laid down under Section 438(2) Cr.P.C.
