2. The petitioner seeks bail in connection with Majhauliya P.S. case no. 520 of 2020 in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.
3. The petitioner is not named in the F.I.R. and is in custody since 21.04.2025.
4. As per FIR, the informant received information that his brother was shot dead at home. On enquiry, he came to know that Dinesh Sahni along with four to five others came to his house and shot him.
5. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.59088 of 2025(2) dt.05-12-2025 2/3 petitioner submitted that initially FIR was registered against seven named and four to five unnamed accused persons. Name of the petitioner surfaced in this case on the basis of confessional statement of co-accused Vijay Yadav. He further submits that co-accused Vijay Yadav who confessed the name of the petitioner has already been granted bail by a coordinate Bench of this Court vide order dated 21.12.2022 passed in Cr. Misc. No. 72302 of 2022.While concluding argument, it is submitted that petitioner found involved in eight more criminal cases where he is on bail and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.
6. Learned APP opposes the prayer of bail.

Considering the aforesaid facts and circumstances that except suspicion arising out of confessional statement of apprehended co-accused nothing incriminating appears against petitioner, coupled with fact that investigation of this case already completed where petitioner remains in custody since 21.04.2025, accordingly
Patna High Court CR. MISC. No.59088 of 2025(2) dt.05-12-2025 3/3 petitioner above named, is directed to be released on bail in connection with Majhauliya P.S. case no. 520 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, West Champaran, Bettiah /concerned court, subject to the conditions as mentioned under Section 480(3) of BNSS.
