JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code.
As per the prosecution case, this petitioner gave Garasa blow on the head of informant's son, Navneet Nischal, as a result of which he sustained severe injury and became unconscious.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that both parties are agnates and land dispute is going on between them. There is case and counter case in which both sides sustained injuries. Petitioner claims clean antecedent and is in custody since 08.09.2021 and
Patna High Court CR. MISC. No.69179 of 2021(2) dt.04-03-2022 2/2 investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case, the period of custody of the petitioner and the backdrop in which the occurrence took place, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Obra PS case No. 151/2020.
