JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-09-2019 This is an application for grant of anticipatory bail in connection with K. Nagar (Shrinagar) P. S. Case No. 159 of 2019, disclosing offences under Sections 365, 366, 366A, 34 of IPC.

Allegation against the petitioner and other accused persons is of kidnapping the minor daughter of the informant. Submission of the learned counsel for the petitioner is that the statement of the victim girl has been recorded under Section 164 Cr.P.C. in which she has not named this petitioner, rather named the co-accused Sarfaraj Alam and others. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the

Nagar (Shrinagar) P. S. Case No. 159 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
