In the present case, the petitioner is assailing the order passed by the Collector, who is the Licensing Authority under the Bihar Targeted Public Distribution System Control Order, 2016.
Learned counsel for the State submits that there is a statutory provision for revision before the Divisional Commissioner in terms of Rule 32 sub-clause 6, which the petitioner has not exhausted.
Let the petitioner file his revision application before the Divisional Commissioner within a period of eight weeks. If
Patna High Court CWJC No.19286 of 2018(2) dt.25-02-2021 2/2 such application is filed by the petitioner, the Divisional Commissioner will decide the matter in accordance with law. While dealing the application for condonation of delay, the Divisional Commissioner would consider about the pendency of this case before this Court.
With the above observation and direction, this writ petition is disposed of.
