JUSTICE SUDHIR SINGH ORAL ORDER 04-07-2017 It has been submitted on behalf of the petitioner that the present case is directly covered by the Judgment of this court in the case of Kalpana Rani Vs. The State of Bihar through the Principal Secretary, Human Resources Development Department, Government of Bihar & Ors reported in 2014(2) PLJR (HC) 665. Learned counsel for the petitioner further seeks permission to withdraw the present writ application with a liberty to prefer an appeal before the State Appellate Authority challenging the order dated 27.08.2009 passed in Case No. 754 of

Patna High Court CWJC No.15618 of 2010 (6) dt.04-07-2017 2/2 2009 by the District Appellate Authority, Banka. Permission is accorded.

The petitioner shall file an appeal before the State Appellate Authority within a period of thirty days from the date of the order and the same shall be disposed of within the statutory period.

The State Appellate Authority shall consider the case of the petitioner in the light of the Judgment of the High Court relied by the petitioner as indicated above.

With the aforesaid direction and observation, the present writ application stands disposed of.
