Ms.Shaheen Begum, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 26-04-2022 Heard learned senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 306 of the Indian Penal Code read with Sections 3 and 4 of the Dowry Prohibition Act. Learned senior counsel for the petitioner submits that the petitioner is in custody since 26.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned senior counsel for the petitioner submits that the informant alleges that the marriage of his daughter (deceased) was settled with Alok Kumar (petitioner) and gifts worth Rs. 15 lakhs were given, thereafter the petitioner along with his family members started torturing her daughter by calling regularly on account of which his daughter committed suicide. Learned senior counsel for the petitioner submits that

No.69893 of 2021(2) dt.26-04-2022 2/2 from perusal of the allegation as alleged in the F.I.R. it would manifest that the daughter of the informant was not married to the petitioner, further the F.I.R. does not even remotely disclose or suggest that what kind of torture was being meted out to the deceased at the hands of the petitioner and his family members. Learned senior counsel further submits that the matter has been compromised as would be evident from Annexure '3' to the bail application.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.09.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and the F.I.R. does not even remotely disclose that what kind of torture was being meted out to the deceased, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Delha P.S. Case No. 81 of 2021.
