The petitioners apprehend their arrest in Nauhatta P.S. Case No. 87 of 2014, registered for the offences punishable under Section 307 and some other Sections of the Indian Penal Code.
Sunita Devi the informant named the petitioners and alleged that they assaulted her father-in-law and when she went to save, the petitioner nos. 1 and 2 have assaulted Chedi Mistry with iron rod.
Considering the facts aforesaid, I am not inclined to
Patna High Court Cr.Misc. No.1939 of 2015 (2) dt.16-01-2015 enlarge the petitioner no. 1 Subhash Mistry and petitioner no. 2 Vipin Kumar @ Bipin Kumar on anticipatory bail. Accordingly, their prayer for anticipatory bail is rejected. So far as the case of petitioner no. 3 Priyanka Devi and petitioner no. 4 Pinki Kumari is concerned, they are ladies, they, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Nauhatta P.S. Case No. 87 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
