2. In this case, the petitioner is seeking regular bail in connection with Bihra P.S. Case No. 95 of 2024, registered for the offences punishable under Section 25(1-B),(a) and 26 of the Arms Act.

3. As per prosecution, on the secret information about conspiring and planning for committing criminal act, the informant along with police personnel proceeded to the place of occurrence where the petitioner was seen standing and on seeing the police party, he started running away but the police on chase apprehended him. On search, one country-made automatic pistol and a live cartridge was recovered from possession of the petitioner.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.64614 of 2024(2) dt.18-09-2024 2/2 petitioner is innocent and has falsely been implicated in the present case. He is a person of clean antecedent. Though the petitioner was an accused in Bihra P.S. Case No. 92 of 2021 but after trial, he has been acquitted by judgment and order dated 21.10.2022. He is under custody since 13.05.2024.

5. On the other hand, learned APP for the State has opposed the prayer for bail of the petitioner.

Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned J.M.-1st Class, Saharsa in connection with Bihra P.S. Case No. 95 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
