JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Pakribarawan P.S. Case No. 217 of 2019 registered for the offences punishable under Sections 419, 420, 467, 468, 471, 472, 120B of the Indian Penal Code and Section 66(D) of I.T. Act.
As per prosecution case, police got an information that some persons were engaged in gambling business of "Chehra Pahchano Inam Pao" and on that information police raided the house of co-accused Jitu Kumar and five persons were arrested and Laptop, Desktop and other articles were recovered and Jitu Kumar has named this petitioner who succeeded in fleeing away.
Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him
Patna High Court CR. MISC. No.57766 of 2019(2) dt.13-09-2019 2/2 and he has no criminal antecedent.
Heard learned APP also.
In view of above facts and circumstances, let petitioner surrender in the court below within two weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Diwakar Kumar, Judicial Magistrate, 1st Class, Nawada, in connection with Pakribarawan P.S. Case No. 217 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation and appear before the police as and when required.
