The petitioner apprehends his arrest in connection with Baghela P.S. Case No. 31 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that there is recovery of 60 liters of foreign liquor in plastic gunny bag on his motorcycle. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner and the petitioner has got no criminal antecedent.

No.55600 of 2019(4) dt.19-11-2019 2/2 In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.30,000/- in the court below and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge (Excise), Rohtas in connection with Baghela P.S. Case No. 31 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

Such deposit of Rs.30,000/- shall abide by the outcome of the criminal case.
