The petitioner is trying to delay the trial as this application has been filed at a belated stage. If the petitioner wanted the charge to be framed under Section 385, he should have filed an application at the stage of framing of charge. Even after framing of charge, the petitioner could have prayed for alteration of charge but, he has waited for the defence witnesses to be examined and when the matter was being argued finally then he has filed this application.
