ANJANA MISHRA ORAL ORDER 13-09-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the opposite parties. Learned counsel for the petitioner submits that since the mother of the child is qualified, the child is not entitled to any such sustenance amount.

Such a submission is only fit to be rejected. Considering the entire facts and circumstances, this Court is not inclined to modify the order dated 05.07.2017 passed in Cr. Misc. No. 49307 of 2016 or reduce the amount to be paid to the daughter of the petitioner by way of interim sustenance less than that which has already stated in the order under reference. Let a copy of this order be sent to the concerned Court who shall ensure compliance of the order. It is further directed that the opposite party No. 2 shall also send a copy of this order to the employer of the

Patna High Court Cr.Misc. No.44491 of 2017 (2) dt.13-09-2017 2/2 petitioner who shall deduct the amount from his salary and deposit it in the account of the child, namely, Shreyasi Sreya which will be communicated to the employer within a period of four weeks from today.

With the aforementioned directions, the modification application stands disposed of.
