The petitioner apprehends his arrest in connection with Kishanpur P.S. Case No. 148 of 2014 registered under Sections 366A, 376 of the Indian Penal Code and 4 of the POCSO Act.
The allegation is that daughter of the informant was abducted by the co-accused Mittu Kumar Singh and Pradeep Kumar Singh for the purpose of marriage.
Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. The allegation is against the co-accused persons. It is also submitted that final form has already been submitted in this case. Further
Patna High Court Cr.Misc. No.54446 of 2016 (4) dt.09-02-2017 2/2 submission is that the victim girl in her statement recorded under Section 164 Cr. P.C. she specifically stated about travelling by train and bus but in the meantime, she did not raise alarm against them.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.-1st, Supaul in connection with Kishanpur P.S. Case No. 148 of 2014(POCSO 04/2015) subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shail/- U T
