JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 18.10.2017 Heard learned counsel for the petitioner as well as learned counsel for the South Bihar Power Distribution Company Limited.

It would appear from perusal of annexure 1 that the petitioner was granted privilege of anticipatory bail vide order dated 13.1.2017 passed in Cr. Misc. no. 524/2017 subject to condition that he shall surrender before the court below within four weeks from the date of receipt/production of a copy of that order and within two months from the date of furnishing bail bonds, he shall deposit 50% of the loss amount with the concerned court but the petitioner could not surrender before the court below in the light of the above

Patna High Court Cr.Misc. No.49868 of 2017 (2) dt.18-10-2017 stated order dated 13.1.2017.

Learned counsel for the petitioner submits that the petitioner could not arrange the amount in question and that was the reason, he could not surrender before the court below within the period as fixed by this court. However now, petitioner has already arranged required amount and wants to surrender before the court below in the light of the order dated 13.1.2017. Therefore, petitioner be permitted to surrender before the concerned court.

In view of submissions as well as the aforesaid facts and circumstances of the case, petitioner is directed to surrender before the court of learned Special Judge (Electricity), Magadh Area, Gaya in connection with Tekari P.S. Case no. 438/2015 within five weeks from today and if the petitioner does so, the concerned court shall pass appropriate order taking note of direction given by this court vide order dated 13.1.2017 passed in Cr. Misc. no. 524/2017.

In the aforesaid manner, this petition stands disposed of.
