The petitioner seeks bail in connection with Chainpur P.S. Case No. 225 of 2015 registered for the offences punishable under Sections 147, 149, 341, 323, 325, 452, 435, 379 and 506 of the Indian Penal Code.

The allegation against the petitioner is general and omnibus.

It has been submitted on behalf of the petitioner that after investigation, charge-sheet has been submitted under Sections 147, 149, 341, 323, 325, 452, 435, 379, 506 except 324 of the Indian Penal Code, but the court below has also taken cognizance including under Section 307 of the Indian Penal Code and there is no specific allegation of assault against

Heard the learned APP also.

Having heard both sides, in view of the fact that there is no specific allegation of assault against the petitioner and he is in custody since 30.09.2016, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhabhua (Kaimur) in connection with Chainpur P.S. Case No. 225 of 2015.
