This application for anticipatory bail arises out of Lakhnaur P.S. Case N0. 86 of 2017, disclosing offences under Sections 147,149,341,323,307,324,504 of the Indian Penal Code.

The petitioner is a Post Master of Tumaniya Post Office. Allegedly, the informant purchased few N.S.Cs, which he wanted to be encashed on maturity. Allegedly, the petitioner assaulted him when the petitioner was insisting for making payment of the maturity value.

It has been submitted on behalf of the petitioner that registration of the present First Information Report is an off shoot of an earlier FIR registered by this petitioner in

Patna High Court Cr.Misc. No.46137 of 2017(3) dt.22-12-2017 2/2 connection with Lakhnaur P.S. Case No. 85/2017. Considering the genesis of the occurrence, I am of the view that a case for grant of anticipatory bail is made out. Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I, Jhanjharpur, in Lakhnaur P.S. Case No. 86 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
