ANJANA MISHRA ORAL ORDER 16-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.07.2019 in connection with Excise Complaint Case No. 141(C)-3/2018, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were not made from the conscious possession of the petitioner, but from a tempo and he is merely the driver of the vehicle.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail

Patna High Court CR. MISC. No.55708 of 2019(2) dt.16-09-2019 2/2 on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Additional District and Sessions Judge, 2ndcum-Excise Act, Khagaria, in connection with Special Excise Complaint Case No. 141(C)-3/2018.
