Mr.J.N. Thakur ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-04-2023 Heard the learned counsel for the petitioner as well as Mr. J. N. Thakur, the learned Additional Public Prosecutor for the State.

The petitioner is seeking regular bail in connection with Bhaptiahi P.S. Case No. 54 of 2021, G.R.No. 396 of 2021, registered for offence punishable under sections 363(A) and 120(B) of the Indian Penal Code.

There is allegation that the petitioner and his family members including his parents, kidnapped the minor daughter of the informant.

The learned counsel for the petitioner has submitted that there was love and affairs between the daughter of the

Patna High Court CR. MISC. No.64659 of 2022(4) dt.17-04-2023 2/3 informant and the petitioner and she with her own sweet will went with the petitioner to Amritsar, Punjab and she resided there. The petitioner is still ready to solemnize marriage with the victim. He is under custody for a period of near about two years and he is a person of clean antecedent. On the other hand, Mr. J.N.Thakur, the learned Additional Public Prosecutor has opposed the prayer for bail. Considering the above-mentioned facts and circumstances and the period of custody as well as clean antecedent of the petitioner, let him be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VI-cum-Special Judge, POCSO Court, Supaul in connection with Bhaptiahi P.S. Case No. 54 of 2021, G.R. No. 396 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner
