JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT Date: 05-05-2016 Heard learned Counsel for the petitioner, learned Counsel appearing on behalf of Magadh University, and learned Standing Counsel No. 32 for the State of Bihar. The petitioner retired as Laboratory Technician, while serving in A. N. S. College, Nabinagar, Aurangabad, a constituent unit of Magadh University, Bodh Gaya, with effect from 31.10.2005. He has a grievance that though he was getting regular pension from the date of his superannuation, but from July, 2010 onwards, no dearness allowance is being added to the petitioner's entitlement for pension. It is also his case that his pension was required to be revised with effect from 01.01.2006, which has so far not been done.

Sunil Kumar Singh, learned Counsel appearing on behalf of the petitioner submits that the action of the respondents is arbitrary and without any valid reason. Learned Counsel appearing on behalf of the University has submitted that the petitioner has filed a representation to the Vice Chancellor of the University, on 23.03.2015, which has been brought on record by way of Annexure 3 to this writ application. He submits that the said representation shall be duly considered.
Considering the pleadings on record and submissions made on behalf of the parties, this application is disposed of with a direction to the Vice Chancellor, Magadh University, Bodh Gaya, to finalize the claim of the petitioner, as raised in his said representation, dated 23.03.2015 (Annexure 3), and ensure payment of all admissible dues accordingly, within a period of three months from the date of receipt/production of a copy of this order before him. If any claim raised by the petitioner is not found admissible by the Vice Chancellor, Magadh University, Bodh Gaya, he will be obliged to record reasons, therefor.
