Mr.Ram Naresh Ray, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 21-04-2022 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in a case registered for the offences under Sections 395 and 397 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 30.04.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that informant alleges that when he came down from upstairs, he saw the door of the house opened and articles, as mentioned in the F.I.R., were stolen and saw his wife in an injured condition, who disclosed the name of the accused persons including the petitioner, who had committed the robbery.

Learned counsel for the petitioner submits that the injured at Para-26 of the case diary has given a specific

The learned counsel further submits that though in the F.I.R. it is alleged that wife was seen in an injured condition and the wife alleges that she was assaulted by Ranjan Bind, but there is no injury report in the case diary. It is further submitted that co-accused Surendra Yadav and Bittu Chauhan have been granted bail vide order dated 03.01.2022 in Cr. Misc. No. 34438 of 2021 and order dated 12.04.2022 in Cr. Misc. No. 65909 of 2021 respectively.

Learned A.P.P. for the State opposes the bail application of the petitioner.

Considering the fact that the petitioner is in custody since 30.04.2021, is a person with clean antecedent, chargesheet has been submitted in the case, and co-accused have been granted bail, let the petitioner above-named be released on bail on furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kako (Bhadawar O.P.) P. S. Case No.30 of 2021.
