2. The petitioner seeks bail in a case registered for the offence punishable under Section-309(4) of the B.N.S.

3. It is alleged that in course of returning home, in the way, two unknown persons riding on a motorcycle, intercepted the informant and snatched his backpack and purse containing Rs. 500 from his pocket and took away his motorcycle and other belongings.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from his possession. No TIP has been conducted till date and except confessional

Patna High Court CR. MISC. No.57804 of 2025(3) dt.21-01-2026 2/2 statement, which is not admissible in the eye of law, there is nothing against the petitioner. The petitioner is in custody since 15-05-2025 and other co-accused on similar footing has been granted bail.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Bounsi P.S. Case No. 109 of 2025 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
