The petitioner seeks bail in a case instituted for the offence under Section 395 of the Indian Penal Code. It is alleged that while informant was traveling from Mourya Train on 28.02.2015, 2-3 unknown persons came and after catching his jacket, pull him down from the train where 3-4 persons were present and at the point of gun, they snatched his mobile, cash of Rs.3500/-, golden ring and silver chain. It has been submitted that petitioner is not named in the written report. No TIP has been held. The name of this petitioner has come in confessional statement of one Kare
Patna High Court Cr.Misc. No.53569 of 2016 (3) dt.27-01-2017 2/2 Mahto, as mentioned in paragraph-120 of the case diary. Counsel for the petitioner has further submitted that Kare Mahto has already been granted bail by Co-ordinate Bench of this Court vide Cr. Misc. No. 44017 of 2016 dated 13.01.2017. Petitioner is in custody since 08.09.2016.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Barauni at Begusarai, in connection with Barauni Rail P.S. Case No. 31 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner.
