JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-10-2017 Heard learned counsel for the petitioners, learned counsel for the informant and learned counsel for the State. The petitioners seek pre-arrest bail in connection with Jamo Bazar P.S. Case No. 17 of 2016 registered under section 366A/34 of the Indian Penal Code.
I have perused the certified copy of the statement of victim recorded under Section 164 of the Code of Criminal Procedure produced by the learned counsel for the informant. Considering the serious nature of allegation made in the statement recorded under Section 164 CrPC by the victim, I am not inclined to grant anticipatory bail to the petitioners.
Patna High Court Cr.Misc. No.42140 of 2017 (2) dt.03-10-2017 2/2 Accordingly, their prayer for grant of anticipatory bail is rejected. In case they surrender and seek bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
