The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 447, 341, 323, 307, 354(B), 427, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act pending in the learned court below.
Allegation against the petitioner is that he along with the others co-accused persons fired upon the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that injury report does not support the prosecution case. He further submits that petitioner has got one
Patna High Court CR. MISC. No.62351 of 2022(3) dt.23-01-2023 2/2 criminal antecedent as stated in para-3 of the bail application. Per contra, learned APP for the State as well as learned counsel for the informant vehemently opposing the bail application and submitted that from perusal of the impugned order, it is clear that gun shot on the left side abdomen region, bullet entry but skin touch exit out, caused by sharp cutting object. Hence, he does not deserve anticipatory bail. Considering the facts and circumstances of the case and the injury report enclosed in annexure-3 of the bail application, I am not inclined to enlarge the petitioner on bail in connection with Rajepur P.S. Case No. 172/2021. Accordingly, his prayer for anticipatory bail is hereby rejected. (Anjani Kumar Sharan, J) ajay/- U T
