ANJANA PRAKASH ORAL ORDER 19-01-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered under Sections 406, 409 and 420/34 of the Indian Penal Code.
It has been submitted that the District Magistrate, Buxar by letter dated 22.10.2007 had recommended purchase of solar product even from Tata B.P. Company as is evident from Annexure-3.
In view of such, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of four weeks from the date of receipt of this order in connection with Begain Gola
Patna High Court Cr.Misc. No.1843 of 2015 (2) dt.19-01-2015 2/3 P.S. case No.66 of 2014 on furnishing bail bonds of Rs.5,000/- (five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as also conditions (i) That one of the bailor will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners.
Patna High Court Cr.Misc. No.1843 of 2015 (2) dt.19-01-2015 3/3 cancelled.
However, if later on it is found that the Petitioners had defalcated Government money, they shall be liable to repay the amount as directed by the authorities concerned notwithstanding the above order.
