The petitioner seeks bail in a case registered under Sections 379/411 of the Indian Penal Code.

Allegedly, the petitioner was caught by people with stolen motorcycle.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-05-2019. Charge sheet in this case has already been submitted. The petitioner has been made accused in the present case due to mistake of fact. There is no other substantive evidence to suggest the implication of the petitioner in the present case. It has further been submitted that the petitioner may be released

Patna High Court CR. MISC. No.54669 of 2019(2) dt.30-08-2019 2/2 after completion of six months in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R. He has got criminal antecedent. Considering the aforesaid facts and circumstances, it is directed that after completion of six months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Supaul in connection with Triveniganj P.S. Case No. 133 of 2019.
