JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,365 and 379 of the Indian Penal Code. It is alleged that the informant was confined by the accused persons including the petitioners. The accused demanded the release of the persons kidnapped at the hands of the informant. Subsequently, the petitioners and Uday Rai snatched the mobile of the informant.

It is submitted by learned counsel for the petitioners that the case lodged by the petitioners' side is earlier in point of time.

No.4075 of 2015 (2) dt.30-01-2015 2/2 Since the petitioner no. 1 has criminal antecedent, let the learned court below consider the prayer for regular bail of the petitioner no. 1 in case the petitioner no. 1 surrenders within six weeks from today in connection with Bachhwara P.S. Case No. 122 of 2013 pending in the court of learned C.J.M., Begusarai. Considering the aforesaid facts, let the above named petitioner no. 2 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with the aforementioned case subject to the conditions as laid down under Section 438(2) Cr.P.C.
