Petitioner is accused in connection with Jagdishpur P.S. Case No. 144 of 2016 registered under Sections 379/411 of the I.P.C., 42 of the Bihar Small Mining Act and 6, 8 of Bihar Mineral Illegal Mining Transportation Act.

The allegation against the petitioner is of carrying the sand illegally by tractor.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is also submitted that petitioner has no criminal antecedent and is in custody since 01.09.2016. Having considered the facts and circumstances of the

No.52967 of 2016 (3) dt.11-01-2017 2/2 case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur in connection with Jagdishpur P.S. Case No. 144 of 2016.
