JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 414 of the Indian Penal Code and sections 30(a), 41(i) of the Bihar Prohibition and Excise Act.
155.52 litres of illicit liquor has been recovered from Swift Car. Petitioner has been made accused in this case simply because motorcycle of petitioner has been seized from the place of recovery.
It is submitted that nothing has been recovered from conscious possession of this petitioner or from his motorcycle in question. Petitioner has got no criminal antecedent. Considering the facts aforesaid, the petitioner above-
