In this case, the petitioner is seeking bail in connection with Gurua P.S. Case No. 87 of 2019 registered for offences under sections 302/120(B)/34 of the Indian Penal Code.

As per allegation, the victim was surrounded and, at the instance of the present petitioner, other co-accused person killed the victim. This fact stands fully supported by the statement of a hearsay witness whose statement has been recorded in paragraph no.28 of the case diary. The petitioner has also made a confessional statement wherein he has stated that though he is a handicapped person but, he is able to drive three Wheeler and he has tried to secure the job but, failed. At present, this Court is not inclined to grant privilege of bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected with a liberty to the petitioner to renew his prayer for bail after one year of his judicial custody.
