Hat P.S. Case No. 865 of 2017, registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code. Petitioner is husband of the deceased and allegation against him is of causing her death in connection with demand of dowry.
It has been submitted on behalf of the petitioner that petitioner is suffering from cancer disease and on that ground, he has prayed for grant of bail Heard learned A.P.P. also and perused the report of Jail Doctor, from which, it appears that his treatment is going and it further appears that as per the submission of learned counsel for the petitioner, trial is going on and only one material witness has remained to be examined apart from the official
Patna High Court CR. MISC. No.56519 of 2019(6) dt.03-03-2020 2/2 witnesses.
Having heard both sides, considering the facts and circumstances, I am not inclined to enlarge the petitioner on bail, however, since the petitioner has been in custody since long, the trial court is directed to expedite the trial and conclude the same as soon as possible even by conducting the same on regular basis.
At the same time, Superintendent of Police, Purnea is directed to see the witnesses including the official are produced in the Trial Court on the date fixed.
The Chief Medical Officer - cum-Civil Surgeon, Purnea is directed to ensure the presence of concerned doctor in the Trial Court on the date fixed so that the trial can be concluded expeditiously.
Let a copy of this order be communicated to the Superintendent of Police, Purnea and the Chief Medical Officer - cum-Civil Surgeon, Purnea for neeful.
With the above observation and direction, this application is dismissed.
