The petitioners apprehend their arrest in a case registered for the offence under Sections 406, 420 of the Indian Penal Code.

As per prosecution case, on the pretext of providing job, father of the petitioners had taken Rs. 12,00,000/- from the informant. And when the informant made a request to the accused persons to refund the said amount, they refused to refund and started assaulting him and threatened him with dire consequences. It is submitted that allegation is against the accused Md. Mokhtar Ahamad, who is alleged to have cheated the

Patna High Court CR. MISC. No.69752 of 2021(2) dt.26-05-2022 2/2 informant in the name of providing government job and taken Rs. 12,00,000/-. So far as these petitioners are concerned, they have been made accused on the basis of false and baseless allegation.

Learned counsel for the petitioners submit that they have been falsely implicated in this case. Petitioners have got clean antecednet.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhagalpur, in connection with Sabaur P.S. Case No. 316 of 2020, subject to condition as laid down under section 438(2) of the code of criminal procedure.
