The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case as per F.I.R is that the informant received information that his younger brother has been shot. The informant was informed by one Bittu Kumar that the accused persons came on the vehicle of Sonu Kumar, called the brother of the informant from home and co-accused Sonu Kumar @ Gautam, Prashant,

Patna High Court CR. MISC. No.69265 of 2021(3) dt.27-09-2022 2/3 Raushan, Bailey shot the brother of the petitioner and fled away along with the driver of the vehicle. After that, the brother of the informant was taken to hospital but in the course of treatment he succumbed to the injuries. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has not committed any offence. It is further submitted that there is neither any specific allegation against the petitioner nor he was named in the F.I.R. It is also submitted that during investigation, this fact came into light that the petitioner was the driver of the vehicle in question. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the
