Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of three weeks on resumption of physical mode. The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code.

The prosecution case is that petitioner alongwith coaccused was coming with stolen JCB machine from Patna and on seeing the police, the petitioner managed to escape. Learned counsel for the petitioner has submitted that there is no recovery from the possession of the petitioner and

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 10th, Sitamarhi in connection with Sitamarhi P.S. Case No. 549 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
