JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2019 This application, for grant of anticipatory bail, arises out of Alipur P.S. Case No. 30 of 2019, disclosing offences under Sections 147, 148, 149, 307, 504 and 506 of the Indian Penal Code.

Prosecution case is that the petitioner and others came to the informant and started abusing, which was objected by his father and nephew, upon whch, one Ranji Kumar opened fire on his father causing injury on his leg and when nephew of the informant came for rescue, accused Abhishek Kumar fired on him causing injury on his leg and, thereafter, petitioner and others also said to have fired.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no specific allegation has been attributed to the petitioner, which is evident

Heard learned A.P.P. as well as learned counsel for the informant. They have opposed the prayer for anticipatory bail on the ground that petitioner is accused in one more case, which has not been disclosed by the petitioner in his petition. Having heard both sides, no doubt, not mentioning about other case in the petition is suppression of fact, however considering the fact that in the present case only general and omnibus allegation has been levelled against the petitioner, as such, let the petitioner, above named, surrender in the court below within two weeks from the date of receipt of order, on which, the court below shall release him on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Alipur P.S. Case No. 30 of 2019, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure with further condition that he will not threaten the informant and will not tamper with the evidence.
