This application, for grant of anticipatory bail, arises out of Sheikhpura Police Station Case No. 132 of 2017, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 307, 427, 504 and 379 of the Indian Penal Code. Learned counsel for the petitioner has submitted that there is land dispute between the parties and a Partition Suit is also pending vide Partition Suit No. 88 of 2016 and on account of that altercation took place between the parties and both the sides have sustained injuries and also case and counter case have

Patna High Court Cr.Misc. No.28055 of 2017 (5) dt.20-09-2017 been lodged by both the parties. Moreover, co-accused Umesh Chaudhary, having more of less similar allegation has been granted anticipatory bail vide Cr. Misc. No. 32809 of 2017. Hence, the petitioners deserve the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura Police Station Case No. 132 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
